Terms of Service

These Terms of Service ("Terms") govern your access to and use of AITuber's AI-powered video creation platform ("Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

1. Acceptance of Terms

By creating an account, accessing, or using AITuber, you represent that:

  • You are at least 13 years old (or 16 in the EEA)
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • All information you provide is accurate and current

2. Account Registration and Security

To use certain features of our Service, you must create an account. You agree to:

  • Provide accurate, complete, and current registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access or security breach
  • Accept responsibility for all activities under your account
  • Not share your account with others or create multiple accounts to abuse free credits

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

3. Service Description

AITuber provides an AI-powered platform for creating faceless videos. Our Service includes:

  • AI-generated voiceovers using text-to-speech technology
  • AI-generated visuals and video content
  • Video editing and customization tools
  • Export capabilities for various platforms and formats

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

4. Subscription Plans and Billing

4.1 Free Credits

New users receive 100 free credits upon registration. Free credits are subject to fair use policies and may be revoked if abuse is detected (e.g., creating multiple accounts).

4.2 Paid Subscriptions

Paid plans provide monthly credit allocations and additional features. By subscribing, you agree that:

  • Subscriptions automatically renew each billing period until cancelled
  • You authorize us to charge your payment method on each renewal date
  • Credits refresh monthly and do not roll over to the next period
  • Unused credits expire at the end of each billing cycle
  • Prices are subject to change with 30 days notice

4.3 Payments and Refunds

All payments are processed securely through our third-party payment provider. Subscription fees are non-refundable except as required by law. If you believe you were charged in error, contact us at billing@aituber.app within 7 days of the charge.

4.4 Cancellation

You may cancel your subscription at any time from your billing dashboard. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date, after which your account will revert to the free tier.

5. Acceptable Use Policy

You agree not to use AITuber to:

  • Create content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
  • Violate intellectual property rights, privacy rights, or other rights of any third party
  • Generate deepfakes, impersonate individuals, or create misleading content without disclosure
  • Distribute spam, malware, viruses, or other malicious code
  • Engage in fraud, money laundering, or other illegal activities
  • Circumvent usage limits, abuse free credits, or manipulate the credit system
  • Reverse engineer, decompile, or attempt to extract source code from our Service
  • Use automated tools to scrape, data mine, or access our Service without permission
  • Interfere with or disrupt the Service or servers

We reserve the right to investigate violations and take appropriate action, including account suspension or termination.

6. Content Ownership and Licenses

6.1 Your Content

You retain ownership of all content you submit to AITuber (scripts, text, etc.). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and display your content solely to provide the Service. We may also review generated content to maintain and improve service quality, ensure platform reliability, and enhance user experience.

6.2 Generated Videos

You retain full commercial rights to videos generated through AITuber. You may use, modify, monetize, and distribute your generated videos freely. However, you are solely responsible for ensuring your use of generated content complies with all applicable laws and third-party rights.

6.3 AITuber's Rights

AITuber and its licensors own all rights, title, and interest in the Service, including all software, technology, trademarks, and intellectual property. These Terms do not grant you any ownership rights in the Service.

7. AI-Generated Content Disclaimer

AITuber uses artificial intelligence to generate videos. AI-generated content may occasionally:

  • Contain errors, inaccuracies, or unexpected results
  • Produce similar outputs for different users using similar inputs
  • Reflect biases present in training data

You are responsible for reviewing and verifying all AI-generated content before publishing or distributing it. We do not guarantee the accuracy, quality, or suitability of generated content for any particular purpose.

8. Disclaimers and Limitations of Liability

8.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AITUBER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless AITuber, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your content or generated videos

10. Third-Party Services

Our Service may integrate with or rely on third-party services (AI providers, payment processors, cloud storage, etc.). We are not responsible for the availability, accuracy, or content of third-party services. Your use of third-party services is subject to their respective terms and privacy policies.

11. Data and Privacy

Our collection and use of your personal information is governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause or notice, for violations of these Terms or any other reason. Upon termination:

  • Your right to access the Service immediately ceases
  • You remain responsible for all charges incurred before termination
  • We may delete your account data and generated content after 30 days
  • Provisions regarding ownership, liability, indemnification, and dispute resolution survive termination

13. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Delaware, United States, excluding conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall first be attempted to resolve through good faith negotiations. If negotiations fail, disputes shall be resolved in the state or federal courts located in Delaware, except where prohibited by law.

14. Changes to These Terms

We may update these Terms from time to time. Significant changes will be communicated via email or a prominent notice on our platform. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must discontinue use of the Service.

15. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and AITuber regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment: You may not assign these Terms without our consent. We may assign these Terms at any time.
  • Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control.
